1. Purpose

1.1. At Voipsol, we are committed to providing our Customers with a platform to express themselves and share information. To maintain a safe and high-quality experience for everyone, we have established the following rules for using our Services.

1.2. Our Fair Use Policy ("Policy”) ensures that:
- a) The safety and rights of all users and Voipsol are protected.
- b) Our Services are used reasonably and responsibly, safeguarding Service quality for all Customers.

1.3. This policy outlines acceptable usage practices and the actions Voipsol may take if these rules are violated. By using our Services, you agree to comply with this Policy.
2. Definitions

2.1.Customer means all Customers of Voipsol including individual and business users, resellers and wholesalers.

2.2.Services means all Services that Voipsol supply including internet, call plans and SIP trunking, phone numbers, PBX features and integrations and more.
- 2.3. Spam means unsolicited electronic messages with an “Australian Link”, as per the Spam Act 2003 (Cth) You - the account holder and anyone the account holder has authorised to access to their Voipsol account and Services.
3. Scope
This Policy applies to all users of Voipsol's Services, including employees, Customers, partners, and any other individuals or entities interacting with our offerings.
4. Acceptable Use
Voipsol expects all users to engage with our Services responsibly and ethically, respecting the rights of others and maintaining the integrity of the resources provided. Users must comply with all applicable local, national, and international laws and regulations. Usage should align with the intended purpose of the Services and remain within any established limits or quotas to ensure fair and equitable access for everyone.
5. Unacceptable Use

5.1. The following activities are strictly prohibited when using Voipsol Services:
- a) Engaging in or promoting unlawful conduct, including fraud, hacking, or the distribution of malware.

b) Disrupting Services or causing harm to other users through Spamming, harassment, or exploitation.
- c) Violating intellectual property rights, such as unauthorized sharing or reproduction of copyrighted materials.
- d) Consuming an unreasonable amount of resources that disrupts Service for others or exceeds allocated limits.
6. Monitoring and Enforcement

6.1. Voipsol shall reserve the right to monitor Service usage to ensure compliance with this policy.

6.2. In the event of any violations of this policy, it may result in the following actions:
- a) Issuance of warnings.

b) Suspension or termination of Services.
- c) Initiation of legal action where applicable.
- d) Reporting of violations to relevant authorities or organizations.
7. Respecting others

7.1. Voipsol Services must not be used to:
- a) Promote or threaten violence against any individual or group.

b) Abuse or harass others, including making offensive, misleading, or threatening comments (this includes interactions with Voipsol staff).
- c) Encourage hate or discrimination.
- d) Create risks to the health or safety of any person.
- e) Send unsolicited or unwanted commercial electronic messages (Spam) to individuals or businesses.
8. Respecting the law

8.1.Voipsol Services must not be used for any illegal or unlawful activities. This includes:
- a) Providing false account information.

b) Hacking or improperly accessing someone else’s information.
- c) Sending or assisting in sending of Spam emails, or otherwise violating the Spam Act 2003 (Cth).
- d) Transmitting or storing data that infringes Australian laws, including prohibited content such as pornography or viruses.
- e) Contravening any applicable laws, including infringement of copyright laws.
9. Respecting Voipsol and our suppliers

9.1.Voipsol Services shall not be used in ways that could harm Voipsol’s network, reputation, or Customer base. This includes:
- a) Using Services in a manner deemed ‘prohibited,’ ‘unreasonable,’ ‘unacceptable,’ or exceeding ‘ordinary use.’

b) Resupplying Voipsol Services or products to others without prior consent.
- c) Using Services for purposes other than their intended use.
- d) Engaging in activities that cause or may cause interference, disruption, congestion, or degrade overall network performance.
- e) Using Services in a manner that breaches Voipsol’s wholesale agreements with third-party suppliers.
10. Technology specific requirements

10.1. Voipsol shall consider the following activities as unreasonable use of VoIP Services:
- a) Auto-dialing.
- b) Robocalling
- c) Continuous or extensive call forwarding.
- d) Maintaining continuous connectivity.
- e) Fax broadcasting/blasting and junk or Spam faxing.
- f) Telemarketing, including charitable or political solicitation and polling.
- g) Call centre operations or generating high call volumes under unlimited business call plans.
- h) Calling or faxing individuals without their explicit consent, including through distribution lists.
- i) Low answer seizure ratio (ASR) of less than 40%.
- j) Low average length of call (ALOC) of less than 15 seconds.
- k) Inbound or outbound minutes exceeding 80% of the aggregate usage of Voipsol Customers.
- l) Average minutes per call exceeding 90% of the aggregate usage of Voipsol Customers.
- m) Improper or unusual usage patterns.
- n) Using a PBX user license for multiple individuals.

10.2. Under SMS Services, Voipsol shall consider the following activities as unreasonable:
- a) Sending bulk or large-volume messages.
- b) Sending unsolicited SMS messages.
- c) Sending messages that do not qualify as standard person-to-person communications.
- d) Application-to-person (A2P) messaging.
- e) Sending phishing or smishing messages, including attempts to obtain personal information or prompting recipients to reply by call or SMS.
- f) Sending messages designed for access hacking, including the use of malicious code or URLs.
- g) Impersonating trusted brands or institutions, including varying or impersonating sender IDs.

10.3. Under Technology-Specific Requirements, Voipsol shall consider the following activities as unreasonable:
- a) Using Internet Services in a manner that causes or may cause interference, disruption, congestion, or sub-optimal network performance.
- b) Undertaking or attempting any unauthorized activities.
- c) Disabling, disrupting, or interfering with the regular operation of any Service or network, such as through overloading, denial-of-Service attacks, or network flooding.
- d) Probing, scanning, or testing the vulnerability of a system or network.
- e) Breaching security or authentication measures for a Service or network.
- f) Servicing more than one premise with a single connection without prior authorization.
11. Policy Breach

a. We may investigate the breach, with or without contacting you.

b. We may request that you change the way you use our Services.

c. We may issue a formal warning.

d. We may modify the terms of Service for your account without notice.

e. We may restrict your access to Services, with or without notice.

f. We may suspend or terminate your Service, with or without notice.

g. If we believe you have broken the law, we will report the breach to law enforcement and provide your personal information as necessary, in line with our Privacy Policy.
12. Updates to our fair use policy
We reserve the right to amend this policy concerning our Services at any time. The updated version of this policy, once posted on our website, becomes effective immediately. Your continued utilization of our Services following any such modifications shall constitute your consent to such changes.
